Article 1 - Scope

These Terms and Conditions of Sale (T&Cs) apply to all sales of Afinaure products (tapware, switches, electrical sockets, furniture and door hardware) concluded through the website [www.afinaure.com] or through any other distribution channel.

Every order implies unreserved acceptance of these T&Cs, which prevail over any other document of the Buyer, in particular their general terms and conditions of purchase.

Afinaure reserves the right to amend its T&Cs at any time. The applicable T&Cs are those in force on the date the order is placed.

Article 2 - Products

The products offered are those featured on the website www.afinaure.com or in our catalogues, subject to available stock.

The photographs and descriptions are as faithful as possible but cannot guarantee a perfect likeness to the actual product, in particular as regards colours and finishes.

Afinaure reserves the right to amend the characteristics of the products at any time. The products comply with the French and European standards in force.

Article 3 - Prices

Prices are shown in euros, inclusive of tax (VAT at the applicable rate included).

Prices include packaging costs but exclude delivery charges, which are billed in addition according to the delivery method chosen.

Afinaure reserves the right to amend its prices at any time. Products are invoiced on the basis of the rates in force at the time the order is registered.

Discounts and promotions:
Any discounts and promotions are indicated on the site and cannot be combined unless otherwise stated.

Article 4 - Ordering

4.1 Order process

An order can be placed:

  • Online at www.afinaure.com
  • By email to commandes@afinaure.com

To place an order online, the Customer must:

  1. Select the products and add them to the basket
  2. Confirm the contents of the basket
  3. Enter their billing and delivery details
  4. Choose the delivery method
  5. Choose the payment method
  6. Accept these T&Cs
  7. Confirm the order and proceed to payment

4.2 Order confirmation

An order confirmation is sent by email to the Buyer summarising:

  • The products ordered
  • The total price inclusive of tax
  • The delivery address
  • The estimated delivery time

This confirmation constitutes acceptance of the order by Afinaure.

Article 5 - Delivery

5.1 Delivery areas

Afinaure delivers to:

  • Mainland France
  • Corsica
  • The European Union

5.2 Delivery times

The delivery times indicated are given for guidance only and run from the order confirmation and payment validation:

  • Standard delivery: [3-12] working days

These times may vary depending on product availability and the destination.

5.3 Delivery charges

Delivery charges are calculated according to:

  • The weight and volume of the order
  • The delivery method chosen
  • The destination

They are shown before final confirmation of the order.

Free delivery:
Offered on any order over €150 to mainland France.

5.4 Receipt of the order

Checking on delivery:
It is the Customer’s responsibility to check the condition of the parcel in the presence of the carrier. In the event of an apparent anomaly (damaged parcel, missing product, broken product), the Customer must:

  • Refuse the parcel or make precise and detailed reservations on the delivery note
  • Photograph the parcel and its contents
  • Inform Afinaure within 24 hours by email with supporting photographs

Absence at the time of delivery:
In the event of absence, a delivery notice will be left. The parcel will be available in accordance with the carrier’s terms. Once the holding period has passed, the parcel will be returned to Afinaure and may give rise to a further charge for shipping costs.

5.5 Late delivery

In the event of a delay of more than 30 days compared with the announced time, the Customer may request cancellation of the order. The amounts paid will then be refunded in full.

Article 6 - Transfer of ownership and risk

Transfer of ownership of the products to the Customer will take place only after full payment of the price, regardless of the delivery date.

The transfer of the risks of loss and damage takes place at the time of delivery and physical possession of the products by the Customer.

Article 7 - Warranties

7.1 Legal warranty of conformity

In accordance with Articles L.217-4 et seq. of the French Consumer Code, the Customer benefits from:

  • A legal warranty of conformity of 2 years from delivery of the goods
  • A legal warranty against hidden defects under Articles 1641 et seq. of the French Civil Code

Implementation:
The Customer may choose between repair or replacement of the goods. The Seller may refuse the chosen solution if it entails a manifestly disproportionate cost.

7.2 Afinaure commercial warranty

All our products come with a 10-year commercial warranty covering:

  • Manufacturing defects
  • Material defects
  • Malfunctions under normal conditions of use

Warranty exclusions:

  • Normal wear and tear
  • Incorrect installation not in accordance with the instructions
  • Improper or inappropriate use
  • Insufficient or unsuitable maintenance
  • Damage caused by a third party or an event of force majeure
  • Modifications or repairs carried out by an unauthorised person

Implementation:
To make a warranty claim, the Customer must contact customer service with:

  • Proof of purchase
  • The product reference
  • A description of the defect found
  • Photographs if necessary

 

Article 8 - Right of withdrawal (private individuals only)

In accordance with Article L.221-18 of the French Consumer Code, the private Customer has a period of 30 calendar days from receipt of the products to exercise their right of withdrawal, without having to give reasons or pay any penalties.

8.1 How to exercise it

To exercise this right, the Customer must notify their decision by:

  • Email to retour@afinaure.com

8.2 Returning the products

The products must be returned in their original packaging, in perfect resaleable condition, complete (accessories, instructions, etc.) within 14 days of the withdrawal notification.

Return costs:
Return costs are borne by the Customer.

8.3 Refund

The refund will be made within a maximum of 15 days from recovery of the products, using the same payment method as that used for the order.

The initial delivery charges are not refunded (except in the case of a defective product or an error).

8.4 Exceptions to the right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

  • Made-to-measure or personalised products

Article 9 - After-sales service and complaints

9.1 Customer service

Our customer service team is at your disposal:

9.2 Defective or non-conforming product

In the case of a defective or non-conforming product, the Customer must:

  1. Contact customer service within [7 days] of receipt
  2. Provide evidence (photos, detailed description)
  3. Return the product in accordance with the instructions given

Afinaure will, as the case may be, replace or refund the defective product.

9.3 Delivery error

In the event of a delivery error (a product different from the one ordered), the Customer must:

  • Report the error within 24 hours of receipt
  • Not use the product
  • Return it in accordance with the instructions given

Afinaure will exchange the product and cover the return and re-shipping costs.

Article 10 - Liability

Afinaure’s liability cannot be engaged in the following cases:

  • Misuse or use of the product not in accordance with its intended purpose
  • Installation not in accordance with the instructions provided
  • Lack of maintenance
  • Force majeure or fortuitous event
  • Act of a third party
  • Malfunction or interruption of the website

Afinaure cannot under any circumstances be held liable for indirect damage (loss of business, loss of opportunity, commercial loss, etc.).

Article 11 - Personal data

The personal data collected is subject to automated processing and is necessary for managing the order and the commercial relationship.

In accordance with the GDPR and the French Data Protection Act, the Customer has the right to access, rectify, erase and object to the data concerning them.

Article 12 - Dispute resolution

12.1 Consumer mediation (private individuals)

In accordance with Article L.612-1 of the French Consumer Code, the private Customer has the option of using, free of charge, a consumer mediator with a view to the amicable resolution of a dispute.

The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr/

12.2 Governing law

These T&Cs are subject to French law.

12.3 Competent jurisdiction

In the event of a dispute and failing an amicable resolution, the competent courts will be those in the jurisdiction of Afinaure’s registered office, unless a contrary legal provision applicable to consumers applies.

Article 13 - Severability clause

If one or more provisions of these T&Cs are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent court, the other provisions will retain all their force and scope.
